Path-Q Solar

Is a PPA or a solar lease easier to transfer when selling a home?

Answer

Neither is automatically easier to transfer. Both depend on the contract, provider, buyer qualification, lender requirements, payoff or buyout options, and the condition of the property transaction. A PPA's production-based payment and a lease's scheduled payment can each create different buyer-underwriting and disclosure issues.

Key points

  • Review transfer, assumption, purchase, termination, and removal provisions before signing.
  • Ask what happens if the buyer will not qualify or the buyer's mortgage lender will not accept the obligation.
  • Check for administrative fees, credit requirements, notice deadlines, and required inspections or documents.

What it depends on

  • Specific PPA or lease contract
  • Provider transfer and credit policies
  • Buyer and mortgage lender requirements
  • Remaining contract term and payment structure
  • Available buyout or early termination amount

Risks and trade-offs

  • A transfer restriction can delay or complicate a sale.
  • Paying off the agreement may require a large amount that is not equal to the equipment's market value.
  • A buyer may negotiate a lower purchase price because of the obligation or uncertainty.

Information you may need

  • The transfer and termination sections of the contract
  • The current payoff or buyout calculation
  • Provider requirements for buyer assumption
  • The anticipated sale timing and buyer financing situation
